ONE OCEAN BONAIRE TERMS & CONDITIONS

Effective Date: May 29, 2023.

By booking accommodation and/or a car at One Ocean Bonaire, you are agreeing to the following terms and conditions, which supersede any previous terms and conditions. Please read and understand these terms before submitting your online booking request.

These terms and conditions are designed to protect both the guests (“Guests”) and One Ocean Bonaire (“One Ocean” or “We”). Your stay at One Ocean will be governed by these terms and conditions, and it is your responsibility to familiarize yourself with them.

Definitions

a. Booking: The act of reserving or booking accommodations, cars, and/or any other services and supplies, which can be done online, by phone, email, in person, or through a third party.

b. Contract: The agreement for the booking and these general terms and conditions (including any other applicable terms and conditions mentioned for the booking).

c. Customer: Refers to an individual, legal entity, or partnership that has entered into an agreement with the accommodation. This term applies to various roles such as a guest, purchaser, tenant, lodger, occupant, tour operator, etc., encompassing anyone who has entered into a contract with the accommodation.

d. Guest: Whenever these general terms and conditions mention guests or customers, it includes both guests and customers unless the context clearly indicates otherwise.

e. Accommodation: One Ocean Bonaire, located in Bonaire CN, and the premises for which the booking is made. It operates under different names, including One Ocean, One Ocean Bonaire, One Ocean Boutique Apartments & Suites, and One Ocean Boutique Apartments & Suites Bonaire.

f. Non-Refundable Rate Bookings: This category includes rate plans such as “Non-Refundable Rate,” “Stay Longer Offer,” “Early Bird Offer,” and “Promotional Rate.”

1. PAYMENT

1.1. All payments must be made in USD or EUR and can be done through either bank wire (IBAN) or online credit card payment. Rest assured that all credit card transactions are securely processed. Once the full payment has been received, a confirmation will be sent to you via email.

1.2. For “Non-Refundable Rate” bookings, the full payment must be made within 72 hours to keep the reservation active. You can choose from various payment methods depending on the country where the booking takes place and the selected rate plan. Within 24 hours, you will receive an email with payment instructions.

1.3. The total balance will be charged for “Standard Rate” bookings at any time. Please note that reservations are not confirmed until full payment is received. If the apartment was booked within 7 days before the arrival date, the total price, including the tourist tax, will be charged at the time of booking. However, no fees will be charged for cancellations made within 4 hours of booking (grace period).

1.4. Please be aware that the accommodation reserves the right to cancel any booking that has not been fully paid for within 30 days prior to the scheduled arrival.

1.5. At our accommodation, we accept payments by Credit Card (Visa, Mastercard, American Express).

2. CANCELLATION

2.1. “Standard Rate” Bookings: You can cancel your reservation free of charge up to 7 days before your planned arrival. If you cancel within the 7 days before arrival or if you don’t show up (“no-show”), the total price of your reservation, including the tourist tax, will be charged. Please note that if you decide to leave earlier than planned, no refunds will be provided.

2.2. “Non-Refundable Rate” Bookings: For these bookings, if you cancel, make modifications, or fail to show up, the total price of your reservation, including the tourist tax, will be charged. After you make the reservation, you will be required to make a prepayment of the total price, including the tourist tax.

2.3. In the event of a group cancellation, our reservation terms and conditions specific to groups will apply.

2.4. If we, the accommodation, need to cancel your booking due to an event of force majeure, you will receive a full refund. However, we will not be held liable for any additional claims or liabilities arising from such a cancellation.

3. GENERAL

3.1. Check-in starts at 4:00 PM. If you arrive earlier, you may be able to move into your apartment early, depending on availability.

3.2. Check-out time is 10:00 AM. If you wish to check out later, you can request a late check-out, subject to availability on the day of departure. Please note that late check-outs will be charged at an hourly rate based on the room’s rack rate.

3.3. When making a booking, you are required to provide your address details, email address, and phone number. Upon check-in, please present a valid identification document.

3.4. Our junior and one-bedroom apartments have a maximum occupancy of two adults, while our two-bedroom penthouse and beach villa apartment can accommodate a maximum of four adults. There are no extra beds available in the apartments.

3.5. Visitors (non-residents) are not permitted in the accommodation without prior approval from the management.

3.6. Complimentary housekeeping services are provided weekly for bookings exceeding 7 days. If you require additional housekeeping, you can arrange it for an additional fee.

3.7. Our accommodation is intended for adults only. Children can be accommodated upon request and confirmation by the management during the booking process.

3.8. All our apartments are designated as non-smoking areas. Any violation of this policy will result in a penalty of USD 500 for deep cleaning.

3.9. We regret to inform you that pets are not allowed in our accommodation.

3.10. Parties or playing loud music, including from the television, are not permitted in the accommodation. We kindly ask all guests to observe total silence between 9:00 PM and 9:00 AM.

3.11. Your stay at One Ocean Bonaire is undertaken at your own risk. One Ocean Bonaire will not be held liable for compensating or providing credit for any loss incurred due to medical issues, family emergencies, delays, or cancellations.

4. CAR RENTAL GENERAL

4.1. You are required to use, handle, and return the car in accordance with the terms stated in the rental agreement.

4.2. When collecting the car, please ensure that you bring a valid driver’s license and either a passport or ID card for identification purposes.

4.3. If you intend to have an additional driver, they must register with us and provide a valid driver’s license. This can be done either when collecting the car or even after the car has already been collected.

4.4. Our policy is based on the principle of “full-is-full” when it comes to fuel. You will receive the car with a full tank, and it is expected that you return the car with a full tank as well. Failure to do so will result in a fee, which includes the daily price of the fuel along with an additional service charge of 25 USD.

4.5. Prior to driving the car, we strongly recommend that you inspect it for any existing damage. If you notice any discrepancies, it is crucial that you report them to us, and we will document them in writing. This will help prevent any disputes or misunderstandings later on.

4.6. The car provided to you is equipped with all the necessary features required for driving in Bonaire. It is our responsibility to rent you a car in good condition and proper working order. In the event of a defect, we will either arrange for repairs or provide a replacement car.

4.7. The following actions are strictly prohibited:

  • Transporting people in exchange for payment
  • Driving on unsuitable or prohibited roads and terrains
  • Overloading the car with excessive passengers or luggage
  • Towing or pushing other vehicles, trailers, or objects without our permission
  • Transporting materials that could be harmful to the car or render it unusable (e.g., substances with strong odors)
  • Transporting cargo in exchange for payment
  • Participating in races, rallies, or other high-speed events
  • Violating traffic rules or engaging in illegal activities
  • Entering the Donkey Sanctuary with our cars
  • Wearing wet clothing, such as swim or dive wear, inside the car

Please note that as the tenant, you are fully liable for any damages not covered by the insurance.

Additionally, damages caused by the following actions are also the tenant’s responsibility:

  • Driving on poor or unsuitable road surfaces that result in damage to the underside of the car
  • Driving on the beach, leading to damage from saltwater and/or sand
  • Driving on flooded roads, causing damage to the engine
  • Improper use of the vehicle, such as adding the wrong fuel or contaminating the fuel
  • Damaging the clutch or parking brake due to incorrect use
  • Causing damage to the rims by driving with a flat tire
  • Installing parts on the interior or exterior of the car without permission
  • Theft in the event of failure to return the keys

4.8. Unauthorized use of the car will result in your full liability for any damages, losses, and costs incurred. In such cases, your insurance coverage will be nullified, and we reserve the right to confiscate the rental car and terminate the rental agreement.

4.9. If you violate any laws, including driving under the influence of substances that impair driving ability (such as alcohol, drugs, or certain medications) or exceeding the speed limit, you will be personally liable for all consequences arising from such violations.

4.10. Any fines received during the rental period will incur a 50 USD administration fee.

5. CAR RENTAL INSURANCE

5.1. The daily rate for the rental car includes legally liable Collision Damage Waiver (CDW) insurance. However, the All Risk-CDW insurance policy is not included in the rental price. In the event of an accident, you and any additional drivers are covered for damage to the rental car and for any third-party damages.

There is an additional charge of 10 USD per rental day for the All Risk-CDW insurance, and the deductible for this insurance is 200 USD.

5.2. The maximum coverage provided by the insurance company for each claim or series of claims resulting from a single event is 83,800.00 USD. However, if reckless driving or the presence of alcohol or drugs is detected in the event of an accident or damage, the insurance will not be valid, and you will be responsible for paying for both the damage to the other party and the damage to the rental car.
In the event of an accident, please exit the vehicle and do not move it to avoid disturbing the accident scene. Always contact the road service (+599 701 0737 / +599 717 9292) and inform us.

5.3. With the All Risk-CDW insurance, you are covered against theft; however, it is your responsibility to ensure the safety of the car. We cannot be held liable for misuse or loss of personal belongings, goods, or luggage belonging to you, the authorized driver(s), or any other users or occupants of the vehicle.

5.4. It is important that you park the car in a secure location to minimize the risk of theft or damage. Always make sure that valuable items are never left unattended in the car, double-check that the car is locked properly, and handle the keys with care.

5.6. If any theft occurs, it is essential that you can hand over the keys to make an insurance claim. Failure to do so will result in your full liability for the damage and/or loss. In the event of the car or any belongings being stolen, you are obligated to inform us and file a report.

5.7. You are also required to cooperate with us and our insurers during investigations and legal proceedings.

5.8. Breakdowns that occur through no fault of your own are covered.

5.9. Unless they are a direct and foreseeable consequence of our negligence or our failure to comply with these rental conditions, we will not be liable for any other losses resulting from the car rental. We are not responsible for lost profits or missed opportunities.

5.10. To the maximum extent permitted by law, our insurance policies will become void if you or an additional driver fail to comply with these rental terms, or if the loss or damage is caused intentionally or through gross negligence.

5.11. Upon request, we can provide you with a copy of the insurance conditions that we have on file.

6. CAR RETURN

6.1. You are responsible for returning the car in the same condition as when it was delivered to you, except for normal wear and tear.

6.2. During the return process, we will inspect the car to ensure that it has been returned in the same condition.

7. DISPUTES

7.1. The general terms and conditions, as well as all matters related to the rental agreements between us, are governed by the law of the BES islands.

7.2. Any disputes that may arise from or in connection with the rental agreement and the general terms and conditions will be resolved by the appropriate court in Bonaire.
