ONE OCEAN BONAIRE TERMS & CONDITIONS

Effective Date: September 2, 2022.
The following supersedes all prior Terms & Conditions. By booking accommodation at One Ocean Bonaire, you agree to the following:

You acknowledge and accept these terms and conditions (these “Terms and Conditions”) by submitting your online request to book accommodation at One Ocean Bonaire, a corporation existing and resident in 159-161 Kaya Gob. N. Debrot, Kralendijk, Caribbean Netherlands.

These Terms and Conditions are intended to protect the guests of One Ocean (“Guests”), and One Ocean Bonaire (“One Ocean” or “We”). Your booking at One Ocean will be governed by these Terms and Conditions, and it is your responsibility to read and understand all of them.

Definitions

a. Booking: the reservation or booking for accommodation(s), car(s) and/or any other services and supplies, made online, by phone, e-mail, in person or through a third party.

b. Contract: the booking agreement and these general terms and conditions (and any other terms and conditions stated to apply to the booking).

c. Customer: natural person or legal entity or partnership which has entered into an agreement with the accommodation and applies equally to the natural person, guest, purchaser, tenant, lodger, occupant, tour operator, etc., anyone who has entered into a contract with the accommodation.

d. Guest: wherever these general terms and conditions speak of the guest(s) or customer(s), this refers to both guest(s) and customer(s), unless it is clear from the content and implication of the clause that only one of the two can be intended.

e. Accommodation: One Ocean Bonaire, established in Bonaire CN, and the premises for which the booking is made, trading, amongst others under the following names: One Ocean, One Ocean Bonaire, One Ocean Boutique Apartments & Suites, One Ocean Boutique Apartments & Suites Bonaire.

f. Non-Refundable Rate Bookings: include the rate plans “Non-Refundable Rate”, “Stay Longer Offer”, “Early Bird Offer” And “Promotional Rate”.

1. PAYMENT

1.1. All payments must be made in USD or EUR and can be done through bank wire (IBAN) or online credit card payment. All credit card payments are processed securely. Once the full amount has been received, a confirmation will be sent by e-mail.

1.2. Full payment of all “Non-Refundable Rate” bookings should be made within 72 hours in order to keep the reservation active. Guests can choose from various payment methods for the reservation, depending on the country in which the booking takes place and the booked rate plan. Guests will receive an email with payment instructions within 24 hours.

1.3. The total balance (incl. tourist tax) for “Standard Rate” bookings will be charged at any time after booking. Reservations are not confirmed until full payment is received. If the apartment was booked within 30 days before arrival the total price (incl. tourist tax) will be charged on time of booking. No fees are charged for bookings canceled within 24 hours of booking (grace period).

1.4 The accommodation reserves the right to cancel any booking that was not fully paid for 30 days prior to arrival.

1.5 At our accommodation, we accept payments by bank transfer or Credit Card (Visa, Mastercard, American Express).

1.6 When booking your reservation with us, you agree to the processing of your personal data in accordance with our privacy policy.

2. CANCELLATION

2.1. “Standard Rate” Bookings: guests can cancel free of charge until 7 days before arrival. In case of cancellation within the 7 days before arrival or if guests don’t show up (“no-show”), they will be charged the total reservation price. In case of premature departure, there are no refunds.

2.2. “Non-Refundable Rate” Bookings: if cancelled, modified or in case of no-show, the total price of the reservation (incl. tourist tax) will be charged. Guests will be charged a prepayment of the total price after booking unless otherwise agreed and noted in your reservation details.

2.3 In case of a group cancellation, our reservation term correspondence is applicable.

2.4. If the accommodation needs to cancel the booking due to COVID-19 restrictions or an event of force majeure the guests will be given a full refund. The accommodation shall, however, have no further liability to the guests arising out of such cancellation.

3. GENERAL

3.1. Check-in from 4:00 PM. Guests who arrive before 4:00 PM can move into their accommodation when ready, subject to availability.

3.2. Check-out until 10:00 AM. Late check-out after this time can be requested subject to availability on the day of departure and will be charged at an hourly rate (based on room rack rate).

3.3. Guests have to provide address details, e-mail and phone number when they book and show a valid ID and or drivers license upon check-in.

3.4. Maximum occupancy for our apartments and suites is two adults and maximum four adults for our two-bedroom penthouse. There is no capacity for extra beds.

3.5. Visitors (non-residents) are not allowed into the accommodation without prior approval from the management.

3.6. Complimentary housekeeping services for bookings over 7 days are provided weekly. Complimentary towel service is provided after 3 nights of stay.  Daily service housekeeping can be booked for an additional fee.

3.7. The accommodation is for adults only.

3.8. All apartments and cars are non-smoking. Violation of this policy will result in a USD 500 penalty for deep cleaning.

3.9. Pets are not allowed.

3.10. Using the accommodation for parties or playing loud music (also from the television) is not allowed. Total silence must be respected between 09:00 PM and 09:00 AM.

3.11. Staying at One Ocean Bonaire is entirely at guests’ own risk. One Ocean Bonaire is not liable for compensating or crediting any guest for any loss incurred due to medical issues, family emergencies, delays or cancellations.

4. CAR RENTAL GENERAL

4.1 You must use, handle and return the car in accordance with the terms of the rental agreement.

4.2 You must bring a valid driver’s license, passport/ID card.

4.3 An additional driver must register with us with a valid driver’s license. This can be done when collecting the car, but also after the car has already been collected.

4.4 We have a ‘full-is-full’ policy. You will receive the car with a full tank of fuel and must return the car with a full tank. If you do not return the car with a full tank, we will charge a fee consisting of the daily price of the fuel and an additional 25 USD service charge.

4.5 Before driving the car, check the car for damage. If you find any discrepancies, you must report them to us. This is then recorded in writing. This way you avoid disputes afterwards.

4.6 The car is equipped with all the necessities that are required to drive a car in Bonaire. We are obliged to rent you a car that is in good condition and that works properly. In the event of a defect, we provide repair or a replacement car.

4.7 The following is not allowed:

  • Transporting people in return for payment
  • Driving on roads and terrains that are not suitable or prohibited access
  • For transporting too many occupants and/or luggage
  • To tow or push other vehicles, trailers and objects without our permission
  • For transporting material that is dangerous for the car or that makes the car unusable (smell)
  • For transporting cargo against payment (except vans)
  • To participate in races, rallies and other speed and agility events
  • For violating traffic rules and other illegal purposes
  • To enter the Donkey Sanctuary with our cars
  • Wear wet clothing like wet swim or dive wear in the car
  • The tenant is fully liable for all damage not covered by the insurance
  • Driving on a bad/unsuitable road surface causing damage to the underside of the car
  • Driving on the beach causing damage from salt water and/or sand
  • Driving on flooded roads causing damage to the engine
  • Improper use of the vehicle, such as adding the wrong fuel or contaminating the fuel
  • Burnout of clutch and parking brake due to incorrect use
  • Causing damage to the rims by driving with a flat tire
  • Installing parts on the inside or outside of the car without permission
  • Theft when you don’t return the keys

4.8 In the event of unauthorized use, you are liable for any damage, loss and costs arising from this. The insurance policies you have taken out will lapse, we will confiscate the rental car and terminate the rental agreement.

4.9 In the event of violation of the law (including being under the influence of substances that affect driving ability such as alcohol, drugs and some medicines, exceeding the speed limit) you are personally liable for all consequences resulting from the violation.

4.10 We charge a 50 USD administration fee for any fines during the rental period.

5. CAR RENTAL INSURANCE

5.1 The rental car day rate includes (legally liable) CDW insurance. All Risk-CDW insurance policy is not included in the rental price. In the event of an accident, you and any additional driver are insured for the rental car and damage to third parties.

The extra charge for All Risk-CDW is 10 USD per rental day. The deductible for the All-risk-CDW insurance is 200 USD

5.2 Limit of the insurance company in respect of any one claim or series of claims arising out of one event is 83,800.00 USD. In case of reckless driving or if alcohol or drugs is detected in the event of damage or an accident, the insurance is NOT valid and the insurance company will not pay. Both, the damage of the other party and the damage to the rental car, must then be paid in full by the registered tenant.

In the event of an accident, get out of the car and do not move your vehicle to not disturb the accident scene and always call the road service (+599 701 0737 /+599 717 9292) and inform us.

5.3 With an All Risk-CDW, you are insured against theft, but you must ensure the safety of the car.  We are not liable for misuse or loss of personal property, goods or luggage of the renter, the authorized driver(s) or other users or occupants of the vehicle.

5.4 You must park the car in a safe place to reduce the risk of theft and destruction. Make sure that valuables are never left unattended in the car, always check that the car is NOT locked and handle the keys with care.

5.6 You must be able to hand over the keys after any theft to claim any insurance. If not, you will be liable for the full damage and/or loss. If the car or one or more belongings are stolen, you are obliged to inform us and file a report.

5.7 You are also required to cooperate with us and with our insurers in investigations and legal proceedings.

5.8 Breakdown caused by no fault of your own is covered.

5.9 We will not be liable for any other losses arising from the car hire unless they are the direct and foreseeable consequence of our negligence or our failure to comply with these rental conditions. We are in no way liable for lost profits or missed opportunities.

5.10 To the fullest extent permitted by law, our insurance policies will be void if you or an additional driver fail to comply with these rental terms, if the loss or damage is caused intentionally or through gross negligence.

5.11 We are in possession of a copy of the insurance conditions that will be provided upon request.

6. CAR RETURN

6.1 You must return the car in the same condition in which we delivered the car, barring normal wear and tear.

6.2 When returning the car, it is checked whether the car has been returned in the same condition.

7. DISPUTES

7.1 In the event of a difference in interpretation of the Dutch and English versions of the general terms and conditions, the Dutch version shall prevail.

7.2 The law of the BES islands applies to the general terms and conditions and to everything between us and the rental agreements.

7.3 All disputes that may arise from or as a result of the rental agreement and the general terms and conditions will be decided by the competent court in Bonaire.
